Regulatory Drafting & Legislative Amendments • Draft and legally vet Bye-Laws and Ordinances for amendment; prepare notification drafts, comparative statements, and cover letters submitted to the Ministry of Finance (MOF). • Coordinate with MOF, which forwards documents to the Law & Justice Division; handle resubmission of clean drafts post-review and track approval milestones through the federal government cycle. • Facilitate Official Gazette publication of approved amendments; collate and incorporate member comments into the notification, and manage the subsequent final-publication cycle. • For Ordinance amendments, coordinate the Cabinet Committee on Legislative Cases (CCLC) approval process, a distinct multi-stage federal review track requiring extended coordination timelines. Legal Opinions & Committee Support • Provide formal legal opinions to the Quality Assurance Department (QAD), Investigation Committee, and Overseas Coordinating Committee in response to their formal referrals. • Assist in election-related legal matters and statutory interpretation queries raised by ICAP's governance and regulatory bodies. • Maintain organized legal opinion files and MIS records to ensure accurate institutional memory and smooth retrieval for future reference. Litigation & Court Appearances • Manage and update the legal cases register, recording case details, next hearing dates, and status updates; prepare periodic case lists for Council review. • Appear before the Hon'ble courts on behalf of ICAP to defend the Institute's legal position in pending matters. • Draft written responses to court appeals, writ petitions, and civil suits; prepare cases from inception including cause of action analysis, documentation, and pleading strategy. Contract & Agreement Drafting • Draft and vet agreements and MOUs ensuring clarity of parties, consideration structures (service-for-remuneration), rights and obligations, termination clauses, Force Majeure provisions, Business Continuity Plans, and arbitration mechanisms for dispute resolution. • Filed institutional intellectual property matters with IPO Pakistan; provided litigation support on QAB decisions and regulatory enforcement cases. MIS & File Management • Maintain and update fee payment files, legal opinion registers, and individual case files as well as dedicated files for each Bye-Law and Ordinance to ensure organized, auditable records.
